Sipekne'katik v Nova Scotia (Environment), 2017 NSSC 254

This case was heard in the Nova Scotia Supreme Court, following the decisions in Sipekne’katik v Nova Scotia (Minister of Environment), 2016 NSSC 260, and Sipekne’katik v Nova Scotia (Environment), 2017 NSSC 23.

Sipekne’katik First Nation was successful in its appeal of a decision by Nova Scotia's Minister of Environment to issue an Industrial Approval to Alton Natural Gas Storage LP. In this decision to determine Sipekne'katik First Nation's cost award, the Court decided how much the Respondent parties would have to pay to cover the Appellant’s legal fees and which parties would be responsible for paying. The Court agreed with Sipekne’katik First Nation on the amount to be awarded. A 65/35 payment formula was established, with the government paying the majority and Alton Gas paying the remainder.
