R. v. NBIP Forest Products Inc., 1994 CanLII 3912 (NB QB)
This case was heard in the New Brunswick Court of Queen's Bench (Trial Division).
After the provincial Crown laid information against NBIP Forest Products Inc. ("NBIP"), NBIP initiated an appeal of the Crown's decision to lay charges. Counsel for NBIP contacted the Department of Environment, Natural Resources and Justice to request the disclosure of several documents related to the case, but the Department denied his request. NBIP then filed a motion asking the Court to order the disclosure of the documents. After considering the relevant law and legal principles, the Court allowed the motion and ordered the Crown to disclose the documents that NBIP had requested.
