R. v. Caldwell & Ross Ltd., 1997 CanLII 1443 (NB CA)

This application for leave to appeal was considered by the New Brunswick Court of Appeal.

The Provincial Court of New Brunswick convicted Caldwell & Ross Ltd. of polluting a municipality’s water supply, in violation of section 21(1) of New Brunswick’s Clean Water Act. The violation was a strict liability offence. Caldwell & Ross Ltd. appealed the conviction, but leave to appeal was denied.
