R. v. B.A. Denton Management Ltd., 1993 CanLII 3451 (NS SC)

This case was heard in the Supreme Court of Nova Scotia.

B.A. Denton Management Ltd. (“Denton”) was convicted of having violated Nova Scotia’s Environmental Protection Act by discharging waste in excess of the allowable limits. Upon conviction, Denton was sentenced to a $300 fine. The Crown appealed the sentence, arguing that it was inadequate.

After reviewing the record and the relevant law and legal principles, the Court held that the Trial Judge had considered the appropriate factors when determining the sentence that should be imposed, and that the sentence, while low, did not warrant interference. The Crown’s appeal was therefore dismissed.
