This case was heard in the Provincial Court of Newfoundland and Labrador.

Mr. Anderson and a number of companions were charged with contravening Canada’s National Parks Highway Traffic Regulations and thereby violating the Canada National Parks Act by operating snowmobiles in a restricted area of Gros Morne National Park. Each of the accused pled guilty to the offence, and so the Court’s sole task was to determine the sentences that should be imposed. In doing so, the Court took into account the purpose of the Regulations and the nature of the offence, including the evidence that Mr. Anderson and his companions had risked harming sensitive wildlife habitat by snowmobiling beyond the permitted areas. Ultimately, the Court sentenced each of the accused to a fine of $600 and twenty-five hours of volunteer work to be performed in Gros Morne National Park.
