This case was heard in the New Brunswick Court of Queen's Bench.

The fishing vessel Étendard was charged with discharging pollutants into Canadian waters after a Department of Fisheries and Oceans vessel observed cardboard boxes and plastic bags trailing behind it. After the Étendard was convicted in the Provincial Court, it appealed to the New Brunswick Court of Queen’s Bench, arguing that the evidence against it had been purely circumstantial. The Court dismissed the appeal and held that the Trial Judge had drawn reasonable inferences from the facts that were available.
