NunatuKavut Community Council Inc. v. Nalcor Energy, 2014 NLCA 46 (CanLII)

This case was heard in the Supreme Court of Newfoundland and Labrador (Court of Appeal).

After Nalcor Energy (“Nalcor”) secured a permanent injunction against members of the NunatuKavut Community Council (“NCC”) who were protesting the development of a hydroelectricity project at Muskrat Falls, the NCC appealed to the Newfoundland and Labrador Court of Appeal.

There, the Court held that the Judge who had ordered the injunction had erred in determining that Nalcor had established a legal basis that would justify the granting of an injunction. It therefore set aside the lower court’s decision and dissolved the injunction.
