Nalcor Energy v. NunatuKavut Community Council Inc., 2012 CanLII 73234 (NL SCTD)

This case was heard in the Supreme Court of Newfoundland and Labrador (Trial Division).

After securing an interim injunction against members of the NunatuKavut Community Council who were protesting the development of a hydroelectricity project at Muskrat Falls, Nalcor Energy (“Nalcor”) applied for a permanent injunction against the protestors.

After reviewing the legal arguments put forward by the parties, the Court held that injunctive relief was appropriate, as Nalcor had established its legal rights and had also established that no other alternative remedy would be effective. The Court therefore ordered a permanent injunction against the protestors.
