Miramichi (Municipal Corporation) v. Concerned Citizens of the Bathurst Highway, 1995 CanLII 3863 (NB QB)

This case was heard in the New Brunswick Court of Queen's Bench (Trial Division).

In the midst of ongoing litigation, three applicants filed a motion asking the Court to issue an injunction restraining Envirem Technologies Inc. (“Envirem”) from continuing its construction of a waste transfer station in Miramichi, New Brunswick. After consideration, the Court held that the applicants had met the three requirements that needed to be met in order for an injunction to be issued—they had proven that there was a serious issue to be tried, that they would suffer irreparable harm if the injunction were not granted, and that the balance of convenience weighed in favour of granting them the relief they sought. The Court therefore issued an injunction for a period of seven days, preventing Envirem from continuing its work until the matter could be considered more fully in another hearing.
