This case was heard before the Nova Scotia Utility and Review Board ("NSUARB").

Millbrook First Nation (formerly the Millbrook Indian Band) challenged a joint decision of the Truro Town Council and the Colchester Municipal Council to approve an agreement allowing for a commercial development by First Truro Shopping Centre Limited on lands that were jointly managed by the two municipalities. The NSUARB considered whether Millbrook had standing to make that challenge, and it found that the community had standing as an "aggrieved person" under the Nova Scotia's Municipal Government Act. under either the authority of the Shopping Centre Development Act, or the Municipal Government Act.
