This case was heard in the New Brunswick Court of Queen's Bench (Trial Division).

Mr. McLaughlin and Mr. Cloutier owned properties in Napan, New Brunswick. An inspector from the Department of Environment discovered that a contractor operating on the properties was extending a road into the buffer zone surrounding nearby wetland. When a verbal warning from the Department was ignored, the Department issued Watercourse/Wetland Alteration Orders. When Mr. McLaughlin and Mr. Cloutier applied for judicial review of the Department’s Orders, the Court found that the Orders had been issued properly and in good faith and should therefore be upheld.
