Hoyt v. Loew, 2008 NSSC 29 (CanLII)

This case was heard in the Supreme Court of Nova Scotia.

Mr. Hoyt alleged that the Loews had disrupted a natural watercourse and damaged a pond on his property. After considering the evidence that was placed before it, the Court concluded that the Loews were in fact responsible for some harm to the quality of the water in the Hoyts’s pond, but were not responsible for the full extent of the harm that the Hoyts had alleged. The Court awarded damages accordingly.
