Boehner Trucking and Excavating Ltd. v. United Gulf Developments Ltd. et al., 2004 NSSC 180 (CanLII)

This case was heard in the Supreme Court of Nova Scotia. 

After the Supreme Court of Nova Scotia granted a summary judgment in relation to three liens that Doug Boehner Trucking and Excavating Ltd. ("Boehner") had filed against United Gulf Developments ("United"), United applied for a further decision by the Court, asking whether summary judgment is available in an action that concerns a lien, and whether the Court should allow the company to present new evidence related to its case.

After considering the relevant law and legal principles, the Court concluded that summary judgment is available in an action that concerns a lien. It also held that United should be allowed to present new evidence related to its case.
