Beaulieu v. Village of Riviere-Verte et al., 1970 CanLII 904 (NB CA)
This case was heard in the New Brunswick Court of Appeal.
After the New Brunswick Court of Queen’s Bench found Berube-Madawaska Contractors Ltd. and the Village of Riviere-Verte liable in negligence for causing the contamination of Ms. Beaulieu’s well water, the defendants appealed the Court’s decision in the Nova Scotia Court of Appeal. There, the Court held that although the lower court had not erred in finding both parties guilty of negligence, it had erred in determining how long the contamination had lasted, and had therefore erred in determining the extent of the compensation that Ms. Beaulieu deserved. The Court therefore upheld the lower court’s findings of negligence but adjusted the damages that the defendants would have to pay to Ms. Beaulieu.
