This case was heard in the New Brunswick Court of Queen's Bench (Trial Division).

Haldor (1972) Ltd. ("Haldor") sought the Department of the Environment’s approval to supply water to the properties in a proposed subdivision. After the Minister rejected Haldor’s application, Haldor sought judicial review of the Minister’s decision.

The Court held that the Minister had acted within his discretion, and that Haldor was essentially asking the Court to weigh in on disagreements concerning the factual bases of the Minister’s decision. The Court stated that its role is not to resolve disagreements about environmental issues “about which there may be honest differences of opinion,” and it dismissed Haldor’s application for judicial review.
